1. כללי וקבלת התנאים
השימוש באתר של משה בן צבי מהנדסים יועצים בע״מ ("החברה") ובאיזור האישי שבו כפוף לתנאים אלה ולמדיניות הפרטיות. יצירת חשבון או שימוש באתר מהווים הסכמה לתנאים. אם אינכם מסכימים — אנא הימנעו משימוש. Use of the website of M. Ben-Zvi Consulting Engineers Ltd. ("the Company") and its member area is subject to these Terms and to the Privacy Policy. Creating an account or using the site means you accept these Terms. If you do not agree, please do not use the site.
2. התוכן אינו ייעוץ הנדסי
המידע באתר הוא מידע כללי על החברה ותחומי פעילותה בלבד. אין לראות בתוכן האתר ייעוץ הנדסי, תכנוני, בטיחותי או מקצועי אחר, ואין להסתמך עליו לצורך תכנון, ביצוע, בנייה או קבלת החלטות. שימוש באתר או יצירת קשר דרכו אינם יוצרים יחסי מתכנן-לקוח, ואינם מהווים התחייבות למתן שירות. שירות הנדסי מקצועי ניתן אך ורק על פי הסכם התקשרות נפרד וחתום. The website content is general information about the Company only. It is NOT engineering, design, safety or other professional advice, and must not be relied upon for planning, execution, construction or decisions. Using the site or contacting us through it does not create an engineer-client relationship and is not a commitment to provide services. Professional engineering services are provided only under a separate, signed engagement agreement.
3. החשבון שלכם
- יש למסור פרטים נכונים ולשמור על סודיות הסיסמה. Provide accurate details and keep your password confidential.
- אתם אחראים לפעילות בחשבונכם. מומלץ להפעיל אימות דו-שלבי (2FA). You are responsible for activity in your account; enabling 2FA is recommended.
- יש להודיע לנו מיד על כל שימוש בלתי מורשה. Notify us promptly of any unauthorised use.
- החשבון מיועד לאדם מעל הגיל המותר לפי הדין החל. Accounts are for individuals above the age permitted by applicable law.
4. שימוש הוגן
אין לעשות שימוש לרעה בשירות, לנסות לפרוץ אליו, להעמיס עליו, לאסוף ממנו מידע בכלים אוטומטיים ללא רשות, או לפגוע בזמינותו או באבטחתו. Do not misuse, attack, overload, scrape without permission, or attempt to disrupt the availability or security of the service.
5. קניין רוחני
כל הזכויות בתוכן האתר, בעיצובו, בסימני המסחר ובחומרים — שמורות לחברה (או לבעלי הרישיון שלה). אין להעתיק, לשכפל או להשתמש בהם ללא היתר בכתב, למעט שימוש אישי וסביר בשירות. All rights in the site content, design, trademarks and materials belong to the Company (or its licensors). Do not copy, reproduce or reuse them without written permission, except for reasonable personal use of the service.
6. זמינות השירות
השירות מסופק כפי שהוא ("As-Is") וכפי שהוא זמין. אנו עושים מאמץ סביר לזמינות, לרציפות ולאבטחה, אך איננו מתחייבים כי השירות יהיה נטול תקלות, רציף או חף מטעויות. איננו מתחייבים לשמירה לצמיתות של תוכן שהעליתם. The service is provided "as is" and "as available". We make reasonable efforts for uptime, continuity and security, but do not warrant that the service will be uninterrupted or error-free, or that content you upload will be retained indefinitely.
7. הגבלת אחריות
במידה המרבית המותרת בדין, אחריות החברה בקשר לשימוש באתר ובאיזור האישי מוגבלת לנזק ישיר וצפוי בלבד, ואיננו אחראים לנזק עקיף, תוצאתי או אובדן רווחים. אין בכל האמור בתנאים אלה כדי להגביל או לשלול אחריות שאינה ניתנת להגבלה או לשלילה על פי דין — ובכלל זה אחריות לנזק גוף או למוות שנגרמו ברשלנות החברה, אחריות למרמה, לזדון או לחוסר תום-לב, וכן זכויות בלתי-ניתנות-לוויתור לפי חוק הגנת הצרכן, התשמ״א־1981, וחוק הגנת הפרטיות, התשמ״א־1981. To the maximum extent permitted by law, the Company's liability in connection with the site and member area is limited to direct and foreseeable loss, and we are not liable for indirect or consequential loss or loss of profits. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law — including liability for death or personal injury caused by the Company's negligence, for fraud, wilful misconduct or bad faith, and any non-waivable rights under the Consumer Protection Law, 5741-1981, or the Protection of Privacy Law, 5741-1981.
אם הוראה כלשהי בסעיף זה תימצא בלתי-אכיפה, היא תצומצם למידה המזערית הדרושה, ויתר ההוראות יעמדו בתוקף. If any part of this section is held unenforceable, it shall be narrowed to the minimum extent necessary, and the remaining limitations shall stay in full force.
8. שמירת זכויות צרכן
אין בתנאים אלה כדי לגרוע מזכויות מגן בלתי-ניתנות-לוויתור המוקנות לכם כצרכנים לפי הדין. אם אתם צרכנים תושבי האיחוד האירופי, בחירת הדין הישראלי (סעיף 10) אינה שוללת מכם את ההגנות המנדטוריות של דין מדינת מגוריכם, שעליהן אתם רשאים להמשיך להסתמך. These Terms do not derogate from any non-waivable statutory consumer-protection rights you have. If you are a consumer resident in the EU/EEA, the choice of Israeli law (§10) does not deprive you of the mandatory protections of your country of residence, on which you remain entitled to rely.
9. שינויים, השעיה וסיום
אנו רשאים לעדכן תנאים אלה או את השירות מטעמים סבירים (למשל שינויי דין, אבטחה או שיפור השירות). שינוי מהותי יפורסם באתר עם תאריך מעודכן; המשך שימוש לאחר מכן מהווה הסכמה. ניתן למחוק את החשבון בכל עת מהאיזור האישי. אנו רשאים להשעות או לסגור חשבון המפר תנאים אלה או הדין, תוך מתן הודעה סבירה ככל שניתן. We may update these Terms or the service for valid reasons (e.g. changes in law, security, or service improvements). Material changes are posted here with an updated date; continued use afterwards is acceptance. You may delete your account anytime from your account page. We may suspend or close an account that breaches these Terms or the law, giving reasonable notice where practicable.
10. דין וסמכות שיפוט
על תנאים אלה יחול הדין הישראלי. סמכות השיפוט נתונה לבתי המשפט המוסמכים בישראל; ואולם אם אתם צרכנים, אין באמור כדי לשלול מכם זכות מוקנית לפי דין לפנות לערכאה במקום מגוריכם, ולא ייתבע צרכן אלא בהתאם לדין החל. These Terms are governed by Israeli law. The competent Israeli courts have jurisdiction; however, if you are a consumer, this does not deprive you of any statutory right to bring proceedings in the courts of your place of residence, and a consumer will only be sued in accordance with applicable law.
11. כוח עליון
לא נישא באחריות לעיכוב או לכשל הנובעים מנסיבות שאינן בשליטתנו הסבירה (למשל תקלות תקשורת או תשתית, אירועי סייבר, כוח עליון). We are not liable for delay or failure caused by circumstances beyond our reasonable control (e.g. network/infrastructure failures, cyber events, force majeure).
12. שונות
אם הוראה כלשהי תימצא בלתי-תקפה, יתר ההוראות יעמדו בתוקפן. ויתור על זכות במקרה אחד אינו ויתור כללי. אין להסב זכויות לפי תנאים אלה ללא הסכמתנו. תנאים אלה, יחד עם מדיניות הפרטיות, ממצים את ההסכם בנוגע לשימוש באתר. If any provision is held invalid, the rest remain in force. A waiver in one case is not a general waiver. You may not assign your rights under these Terms without our consent. These Terms, together with the Privacy Policy, are the entire agreement regarding use of the site.
